An 82-year-old state senator faces racketeering and money laundering counts linked to a business she co-owns, sparking debate over the timing of the indictment.

The federal government has moved to charge Virginia state senator Louise Lucas with racketeering, money laundering conspiracy, and conspiracy to distribute marijuana. The 82-year-old Democrat, who serves as the president pro tempore of the state senate, surrendered to authorities on Thursday. She is currently in custody along with six other individuals, several of whom are relatives.
Attorney General Todd Blanche and FBI Director Kash Patel announced the charges at a press conference in Norfolk. Blanche stated that the Justice Department intended to prove Lucas prioritized her own financial interests over her constituents in Portsmouth and Chesapeake. He emphasized that the case is not politically motivated, urging the public to review the indictment to see that the department does not engage in political paybacks.
The timing of the move has drawn scrutiny because it occurred just 12 days before the midterm election. Federal authorities have traditionally avoided taking significant investigative steps against political figures so close to a vote. While Lucas is not up for reelection this year, she maintains strong ties to prominent Democrats who are on the ballot. Virginia Governor Abigail Spanberger argued in a statement that the timing undermined the department's longstanding policy of avoiding pre-election legal actions. She noted that Lucas is presumed innocent until proven guilty and deserves the opportunity to present a defense.
Lucas has framed the prosecution as an act of intimidation by the Trump administration. In a social media statement, she described the use of the full weight of the federal government against her as an attempt to silence a critic. She recalled growing up under Jim Crow and stated that she has spent her life fighting back and would not stop now. In a separate intercepted phone call from February, Lucas allegedly told an unindicted co-conspirator that the business represented their last chance at generational wealth and that she had gotten too old to avoid being greedy.
The indictment alleges that the conspiracy used various business entities to disguise proceeds from illegal marijuana distribution. It further claims that Lucas used her political position to insulate the enterprise from criminal scrutiny to accumulate wealth. Federal agents searched her office in Portsmouth and her co-owned business, The Cannabis Outlet, in May. The store, which Lucas opened in 2021, sells legal hemp and CBD products, though local media have noted allegations that some items were mislabeled. Virginia has legalized possession of marijuana, but retail sales for recreational use remain illegal.
Lucas has served as a state senator for 34 years and is known for her role in recent redistricting efforts. She previously told NBC Washington that the timing of the May search was a coincidence following her push for Democrat-friendly district maps. She has long been a backer of marijuana legalization and is currently the CEO of a Portsmouth business that provides residences and programs for intellectually disabled adults. Her career includes historic firsts, such as being the first Black woman elected to the Portsmouth city council and the first female shipfitter at the Norfolk Naval Shipyard.
The investigation predates the current administration, but the move has intensified political tensions. Rep. Suhas Subramanyam, a Democrat, stated that his communications with Lucas were monitored and criticized the Justice Department for acting like a personal law firm for the president. A reporter from an NBC affiliate also received a notification that his calls to Lucas were included in the wire. As the legal process begins, the case has become a focal point for debates over federal power and electoral timing.
